On Monday 13 February, High Court judge Justice Whata released his decision on appeals to the zoning in the Unitary Plan.
The Character Coalition/Auckland 2040 appeal against the late upzoning of 29,000 residential properties was declined, along with most of the other zoning appeals.
The complex 143 page judgement in essence is saying that regardless of any issues of fairness, the special government legislation put in place to run the Unitary Plan process gave the Independent Hearings Panel the ability to do whatever they deemed necessary.
